XV General Assembly of IOTA, Nice, 7 - 8 July 2011

The 15th General Assembly of the Intra-European Organisation of Tax Administrations (IOTA) was organized and hosted by the General Directorate of Public Finance of France and held in Nice on 7 – 8 July 2011. It was attended by over 160 delegates from Member Tax Administrations, French Government, European Union, OECD, IMF and other representatives of international organizations, tax practitioners and researchers.

TAX ADMINISTRATION SIGNIFICANTLY REDUCED TAX ARREARS

In line with the Agenda for precisely planned activities, the Tax Administration, apart from regular monthly collection tasks, also carries out the collection of tax arrears. During MAY 2011 the Tax Administration earned income in the amount of 6.185.488,00 € for the State Budget, collecting the "delinquent debt".

LECTURE AT THE FACULTY OF BUSINESS MANAGEMENT

On Tuesday, May 31 2011, the Tax Administration organized a lecture for III and IV year students of the Faculty of Business Management. The lecture was organized as a result of the agreement reached between the MTA and this Faculty and as a part of the traditional mutual cooperation. In duration of 4 classes, the lecture was held by MTA representatives presented the organisational structure (Gordana Stajčić - Headquarters) and work system of the Regional Office Bar and the branch office Ulcinj (Zorica Tomić - Head of the Regional Office). Radio Bar covered the lecture.

MTA’s interventions for provision of tax returns

In line with current legislation, taxpayers are obliged to submit VAT returns (PR PDV 2) and monthly reports on excise for alcohol and alcoholic beverages (OAKC-AL), tobacco products (OAKC-DP) and mineral oils, their derivatives and substrata (OAKC-MU) by the 15th of the following month. If a taxpayer does not comply with the legal deadline, the Tax Administration makes interventions for provision of these tax returns, including delivery of written notifications and reminders by telephone, and in some cases even personal delivery of notices to taxpayers.

Ministry of Finance and Tax Administration -Press Release One Stop Shop for Registration of Companies

Within activities of the Council for Regulatory Reform and Improvement of Business Environment, preconditions for establishment of the one stop shop system for registration of companies within the Central Registry of the Commercial Court (CRPS) have been created. As of today, May 20 2011, new business organisations will be able to register a company, apply for general tax registration, obtain VAT, excise and customs number in one place. In that way they will not have to visit counters in several different institutions, what will save their time and money. While until now registration was possible only in the Central Registry of the Commercial Court, in the following period, upon realisation of planned activities, registration of companies in 8 regional offices of the Tax Administration will be enabled.

JOINT PRESS RELEASE

16.05.2011, Podgorica – Representatives of the MTA (Montenegrin Tax Administration) and MEF (Montenegrin Employers Federation) met on the premises of the MEF, for analysing the economic conditions and agreeing on continuation of the cooperation and realisation of future common activities. Assessing the previous cooperation as very successful, participants noted that the natural connection between the MEF and MTA requires further strengthening of the partnership, especially with reference to current economic conditions. It was pointed out that difficult business operation indicates the need for intensifying of the work of the MEF & MTA Steering Committee, for timely detection of problems, identification of ambiguities and dilemmas and professional interpretation to help efficient and practical application of tax legislation in employers practice.

TAIEX WORKSHOP ON „VAT FRAUD- CAROUSEL FRAUD“

Today (May 11 2011) Tax Administration within the EC Instrument TAIEX Instrument organised a two days workshop on “VAT Fraud- Carousel Fraud” for 20 tax auditors from Podgorica, Nikšić, Bijelo Polje and Berane. Lecturers on this topic, very interesting for our tax system, were tax experts from Belgium and Denmark, Mr. Peter Depydt, Mr. Dominique Driesen and Mr. Reino Nielsen, as well as a representative of the MTA, Ms. Gordana Pejović, tax auditor from Nikšić and member of IOTA Area Group VAT Fraud.

VAT REFUND CLAIMS OVER 6,1 MILLION € DURING MARCH

During MARCH 2011 112 claims for VAT refund and redirection of funds from tax credit for clearance of other tax liabilities were submitted to the Tax Administration. The Tax Administration, for determination of groundedness of refund claims, accomplished necessary inspections and audits, followed by relevant decisions. The total amount of VAT credit declared in submitted refund claims is 6.141.948,08€, 3.049.095,12€ for refund to taxpayers and 3.092.852,96€ for redirection for payment of other tax liabilities.

ANNOUNCEMENT FOR TAXPAYERS – NATURAL PERSONS

The Tax Administration would use this opportunity to remind taxpayers- natural persons who made income in 2010 on the grounds of: - Personal income disbursed by two or more employers and non-employment personal income; - Independent business activity, being the main activity of the taxpayer, except for the income subject to flat - rate taxation; and - Property and ownership rights, that they are obliged to submit the annual personal income tax return (GPP_FL Form) and pay the calculated tax no later than April 30 2011. The return shall be submitted to the competent tax authority depending on the place of residence of the taxpayer.

The Tax Administration of Montenegro continues with provision of assistance in the public administration reform process, among other by strengthening capacities of civil servants, in charge of and participating in administrative and offence proceedings and resolution of administrative affairs. In this respect, a one day seminar was organized today (21.04.2011) in the Tax Administration Headquarters for 20 MTA officers from Podgorica and Nikšić.
